Terms of Service
These terms were prepared as a practical Philippines-focused baseline for Kumbida Likha's digital invitation business, including hosted wedding and event pages. They are written to align with the project's current workflow, the Data Privacy Act of 2012, and the Electronic Commerce Act of 2000.
They should still be reviewed and customized further once your registered business name, billing process, hosting duration, and final client contract workflow are fixed.
1. Scope of these Terms
These Terms of Service govern access to and use of the Kumbida Likha website, digital invitation pages, wedding or event microsites, and related design, hosting, customization, and support services offered through this site (collectively, the "Services").
These Terms apply both to clients who commission invitation work and to guests or visitors who access hosted invitation pages. If a separate written quotation, invoice, proposal, or project agreement is issued for a client project, that project-specific document will control to the extent of any direct conflict.
2. Acceptance and electronic transactions
By accessing the site, submitting an inquiry, approving a design, paying an invoice, or using a hosted invitation page, you agree to these Terms and our Privacy Policy.
Consistent with Republic Act No. 8792, also known as the Electronic Commerce Act of 2000, the parties may use email, chat, online approvals, and other electronic records as valid evidence of instructions, approvals, and service communications unless a different formal process is expressly required by law or by a signed project agreement.
3. Who may use the Services
You must have legal capacity under applicable Philippine law to enter into a binding agreement. If you act on behalf of a couple, family, business, church, school, or organization, you represent that you are authorized to give instructions and approvals for that event or entity.
4. Service description and reasonable expectations
Kumbida Likha provides custom digital invitations and related event microsites for weddings, birthdays, baby showers, anniversaries, corporate events, and similar occasions. Depending on the selected package or custom quotation, services may include themed page design, galleries, programme sections, background music, maps, media integration, domain or hosting setup, and limited post-delivery support.
The Services are creative and collaborative in nature. Timelines, output scope, revision count, supported features, hosting duration, and third-party costs may vary based on the selected package, custom requests, client responsiveness, and supplier dependencies.
5. Client responsibilities and approvals
Clients are responsible for providing complete, accurate, and lawful event information, including names, dates, venues, programme details, photo and video assets, social links, music requests, and any other materials submitted for publication.
You agree to review drafts carefully before final approval. Once a draft, wording, schedule, sponsor list, photo set, or other content is approved for release, Kumbida Likha may rely on that approval. The client remains responsible for typographical errors, outdated schedules, broken third-party links, or missing names that were present or discoverable before final approval.
6. Client content, intellectual property, and permissions
You retain your rights over original photos, videos, logos, copy, and other materials you submit, subject to the rights of any photographer, studio, musician, designer, church, venue, or other third party that owns or controls those materials.
By submitting content to Kumbida Likha, you represent that you have the necessary rights, licenses, consents, and permissions to use, reproduce, edit, display, host, and publish that content for the requested project. You grant Kumbida Likha a non-exclusive license to use those materials only as reasonably necessary to perform the Services.
Unless otherwise agreed in writing, Kumbida Likha retains ownership of its site structure, code, layout systems, reusable components, design methods, branding elements, and pre-existing creative assets. Upon full payment, the client receives a limited, non-transferable right to use the delivered invitation for its intended event purpose.
7. Acceptable use for hosted pages
You may not use the Services to publish or transmit unlawful, defamatory, obscene, fraudulent, infringing, harassing, hateful, or misleading content, or to violate privacy, publicity, intellectual property, election, consumer, or child protection laws.
Hosted pages may not be used for phishing, spam, malware distribution, unauthorized data harvesting, fake promotions, political disinformation, or any activity that may expose Kumbida Likha, guests, or third parties to legal, reputational, or security risk. Kumbida Likha may suspend, remove, or refuse publication of content that reasonably appears to violate these Terms, a third party's rights, or applicable Philippine law.
8. Privacy and personal data
The Services may involve the processing of names, contact details, event dates, schedules, RSVP-related information, media files, and other personal data. Each party agrees to handle personal data in a manner consistent with Republic Act No. 10173, also known as the Data Privacy Act of 2012, and its implementing rules.
If you provide personal data belonging to guests, sponsors, family members, entourage members, or suppliers, you are responsible for ensuring that you have an appropriate lawful basis and any necessary notices or consents before submitting that information for publication or processing.

9. Pricing, payment, revisions, and cancellations
Published pricing is informational and may be updated from time to time. Final scope, package inclusions, turnaround, and payment schedule are based on the quotation or agreement accepted for a specific project.
Revision limits, if any, follow the selected package or custom agreement. Requests beyond the agreed scope may be billed separately or moved to a higher package. Refunds, rebooking, and cancellation rules are governed by the client agreement and, where applicable, our Refund Policy.
10. Hosting, uptime, and third-party services
Kumbida Likha may rely on third-party providers for hosting, analytics, CDN, email, messaging, maps, social embeds, payments, domain services, or media delivery. While we aim for reliable availability, uninterrupted access cannot be guaranteed because outages, maintenance, force majeure events, internet issues, platform changes, and third-party failures may occur.
Links to Facebook, WhatsApp, maps, venues, registries, and other third-party destinations are provided for convenience. Kumbida Likha is not responsible for their separate terms, privacy practices, content changes, or service outages.
11. Portfolio and promotional use
Unless a client agreement states otherwise, Kumbida Likha may display published invitations, screenshots, project descriptions, and non-sensitive excerpts in its portfolio, social channels, or marketing materials for the limited purpose of showing completed work.
On reasonable written request, Kumbida Likha may withhold especially private or unpublished work from public portfolio use, subject to prior agreements and any materials already lawfully published.
12. Warranty disclaimer and limitation of liability
The Services are provided on an "as available" and "as reasonably achievable" basis. Nothing in these Terms excludes rights that cannot be waived under applicable Philippine law, including mandatory consumer protection rules.
To the fullest extent permitted by law, Kumbida Likha will not be liable for indirect, incidental, special, consequential, exemplary, or reputational damages, or for loss of profits, guests, goodwill, or anticipated event outcomes arising from delays, incorrect client-supplied content, third-party outages, venue changes, force majeure, or unauthorized access beyond reasonable security controls.
Where liability cannot be excluded, Kumbida Likha's aggregate liability for a specific client project will be limited to the amount actually paid by the client for that project, except where a higher liability is required by law.
13. Indemnity
You agree to defend, indemnify, and hold Kumbida Likha harmless from claims, losses, liabilities, and reasonable costs arising from client-supplied content, missing permissions, inaccurate event information, unlawful use of the Services, or breach of these Terms, except to the extent caused by Kumbida Likha's own willful misconduct or non-waivable legal fault.
14. Governing law and dispute handling
These Terms are governed by the laws of the Republic of the Philippines. The parties will first try in good faith to resolve any dispute through discussion and practical correction. If that is not possible, disputes may be brought before the proper courts or authorities in the Philippines, without prejudice to any mandatory consumer, privacy, or regulatory remedies available under law.
15. Changes to these Terms
Kumbida Likha may update these Terms from time to time to reflect service changes, legal requirements, or operational improvements. Updated Terms take effect once posted on this page, unless a later date is stated. Continued use of the Services after an update means you accept the revised Terms.
